Welcome to Brayne Jewelry (“we,” “us,” “our”). By accessing or purchasing from braynejewelry.com, you (“customer,” “you,” “your”) agree to be bound by these Terms & Conditions (“Terms”). Please read them carefully before using our website or making a purchase.

1. Acceptance of Terms

By using our website, engaging with us on social media, or placing an order, you agree to comply with and be bound by these Terms, our Privacy Policy, Refund & Returns Policy, and any other policies referenced herein. If you do not agree, please do not use our website or services.

2. Products & Orders

a. Custom Jewelry

• Brayne Jewelry specializes in custom-made necklaces, rings, and other personalized jewelry.
• Customers are responsible for ensuring all personalization details (names, spellings, design preferences, sizes) are correct before finalizing an order. We are not responsible for errors submitted by the customer.

b. Product Images & Descriptions

• While we strive to display product images and descriptions as accurately as possible, slight variations may occur due to screen differences, materials, or customization methods.
• All images, descriptions, and designs are the intellectual property of Brayne Jewelry.

3. Pricing & Payments

a. Prices

• All prices are listed in PHP and/or USD (as displayed), inclusive of VAT/GST where applicable unless otherwise stated.
• Prices and promotions are subject to change without prior notice.

b. Downpayment & Balance

• A 50% downpayment is required to confirm and begin production of all custom jewelry orders.
• The remaining 50% can be paid ahead of delivery via our payment channels or upon delivery through Cash on Delivery (COD), where available.

c. Payment Methods

• We accept major credit/debit cards, bank transfers, GCash, PayPal (where available), and COD (for the remaining balance, in select locations).
• Payment must be made in full before items are shipped or released.

4. Shipping & Delivery

a. Shipping Fees

• Customers are responsible for shipping fees unless a “Free Shipping” promotion is explicitly stated or offered at checkout.

b. Shipping Locations

• We ship nationwide within the Philippines and internationally, subject to courier coverage and local regulations.

c. Delivery Times

• Production time for custom orders is typically 7–15 business days.
• Delivery timeframes are estimates and may vary depending on your location, courier, and external factors.
• Tracking information will be provided upon dispatch where available.

d. Risk of Loss

• All items purchased are made pursuant to a shipment contract. Risk of loss passes to you upon our delivery to the carrier.

e. Address Accuracy

• Please ensure your delivery address and contact details are complete and accurate. Brayne Jewelry is not liable for delays, losses, or additional charges resulting from incorrect information.

5. Order Changes & Cancellations

• Changes or cancellations to custom orders may only be requested before production begins.
• Once production has started, orders cannot be modified or canceled.
• For non-custom orders, cancellation requests must be received before shipment.

6. Refunds, Returns & Exchanges

• Our Refund & Returns Policy is fully integrated into these Terms.
• Custom-made items are non-refundable and non-returnable, except in cases of manufacturing defect, damage on arrival, or incorrect item sent (see full Refund & Returns Policy for details).
• Non-custom items may be returned or exchanged within 7 days of receipt, provided they are unused and in original packaging.
• Shipping fees are non-refundable unless the return is due to our error.

7. Intellectual Property

• All content on this site, including images, designs, logos, graphics, and text, is the intellectual property of Brayne Jewelry or its licensors.
• Unauthorized use, reproduction, or distribution of our intellectual property is strictly prohibited.

8. Promotions, Discounts & Vouchers

• Promotions, discounts, and voucher codes are valid only as stated and cannot be combined unless expressly allowed.
• Brayne Jewelry reserves the right to modify or cancel promotions at any time.

9. Limitation of Liability

• To the fullest extent permitted by law, Brayne Jewelry shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or purchase of our products.
• Our total liability for any claim arising out of these Terms shall not exceed the amount paid for the product(s) in question.

10. Indemnification

You agree to indemnify, defend, and hold harmless Brayne Jewelry, its affiliates, employees, and agents from any claims, losses, liabilities, damages, expenses, or costs resulting from your violation of these Terms, misuse of our products, or infringement of any third party’s rights.

11. Governing Law

These Terms are governed by the laws of the Philippines. If you are located outside the Philippines, you may also have additional rights under your country’s consumer protection laws (e.g., USA, Canada, UK, Australia).

12. Dispute Resolution

We encourage you to contact us first to resolve any dispute amicably. If unresolved, disputes may be submitted to the appropriate courts in Cavite, Philippines, unless otherwise required by mandatory law.

13. Amendments & Updates

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes constitutes acceptance of those changes.

14. Severability

If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect.
